We will only collect sensitive information where it is reasonably necessary and where we have your consent or are otherwise permitted by law.

  • directly from you when you contact us, complete forms, apply for a property, attend inspections or engage our services
  • from your authorised representative, solicitor, conveyancer, accountant, mortgage broker or other professional adviser
  • from landlords, tenants, buyers, sellers, referees, employers, strata managers, tradespeople or government bodies
  • through third-party platforms used for property applications, identity verification, property management, sales, marketing, electronic signing or payment processing
  • from publicly available sources, such as land title records, property databases, company searches, tribunal records or online searches.

Where practical, we collect personal information directly from you.

4. Why we collect personal information

We collect, use and hold personal information to:

  • provide real estate sales, leasing and property management services
  • verify identity and authority to act
  • assess tenancy applications and manage tenancies
  • market, sell, lease, manage or appraise properties
  • communicate with clients, customers, tenants, landlords, buyers, sellers and service providers
  • prepare and manage agency agreements, contracts, leases, offers and related documents
  • arrange inspections, repairs, maintenance and property access
  • process payments, rental payments, bonds, deposits, invoices and trust account records
  • comply with NSW property laws, Fair Trading requirements, trust accounting obligations, privacy laws, AML/CTF obligations, court/tribunal orders and other legal obligations
  • prevent fraud, unlawful activity, money laundering, terrorism financing and misuse of our services
  • handle complaints, disputes, insurance matters and legal claims
  • improve our services, systems, training and business operations.

5. What happens if you do not provide information

If you do not provide the personal information we reasonably request, we may not be able to:

  • provide real estate services to you
  • verify your identity or authority
  • process your application, offer or agreement
  • manage a property, tenancy, sale or purchase
  • comply with our legal obligations.

In some cases, we may need to decline, delay or stop providing services.

  • sellers, buyers, landlords, tenants and their authorised representatives
  • solicitors, conveyancers, mortgage brokers, accountants and financial advisers
  • strata managers, building managers, valuers, inspectors and tradespeople
  • tenancy application platforms, property management systems, CRM providers, electronic signing platforms, ID verification providers and payment providers
  • referees, employers and tenant database providers where permitted by law
  • government agencies, regulators, NSW Fair Trading, AUSTRAC, law enforcement bodies, courts and tribunals
  • insurers, debt collectors, dispute resolution bodies and legal advisers
  • IT service providers, cloud storage providers and business support providers.

We do not sell your personal information.

We may use third-party technology platforms to help provide real estate services, including property portals, tenancy application platforms, CRM systems, electronic signing tools, ID verification tools and payment systems.

Where third-party platforms are used, their own privacy policies may also apply. We take reasonable steps to use reputable providers and limit the personal information collected and retained to what is reasonably necessary.

8. Direct marketing

We may use your contact details to provide property updates, market updates, service information or marketing communications where permitted by law.

You can unsubscribe or opt out at any time by contacting us or using the unsubscribe option in our communications.

9. Security and storage

We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification or disclosure.

We may store personal information in physical files, electronic systems, cloud platforms and secure third-party systems. Access is limited to authorised personnel and service providers who need the information for legitimate business purposes.

Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) legislation 01/07/2026

At Engage Real Estate & Property Services, we are committed to providing a seamless, transparent and secure experience for every client.

We would like to inform you of important changes to Australian property transactions that will take effect from 1 July 2026.

New Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) legislation will apply to all real estate agencies across Australia, including Engage Real Estate.

These reforms introduce new legal obligations requiring real estate agencies to verify the identity of clients and undertake certain due diligence before providing specific real estate services.

While these requirements are new to the property industry, they have been standard practice for many years across banking, finance, accounting and legal services.

Why are these changes being introduced?

The Australian Government has expanded the AML/CTF framework to help protect Australia’s financial system and property market by reducing the risk of:

Money laundering and organised crime

Fraud and financial misconduct

Terrorism financing

The misuse of property transactions for unlawful activities

The inclusion of the real estate industry forms part of a broader national framework designed to strengthen transparency and integrity across regulated industries.

What does this mean for you?

If you are buying or selling property we are required to verify your identity before we can provide certain real estate services.

Depending on your circumstances, this may include requesting:

Proof of identity

Confirmation of your residential address

Information relating to companies, trusts or other ownership structures

Where a property is owned or purchased through a company, trust or similar entity, we may also be required to identify the individuals who ultimately own or control that entity.

What will the process look like?

At Engage Real Estate, our priority is to make this process as simple, secure and efficient as possible.

Most clients will receive a secure digital request to complete their identity verification through Annature Biometrics, a specialist compliance platform developed specifically for the Australian Finance & Real Estate Industry.

Once submitted, our team will review the information to satisfy our legal obligations before proceeding with your transaction, allowing us to continue delivering the premium service you expect from Engage Real Estate & Property Services.

Is my information secure?

Absolutely.

Protecting your personal information is of the utmost importance to us. Verification information will be securely managed through Annature Biometrics VOID certified platform’ designed to meet rigorous information security and privacy standards.

Your information will only be collected and used for AML/CTF compliance purposes and handled in accordance with applicable Australian privacy legislation.

Existing Clients

If you have previously bought or sold property through Engage Real Estate, the legislation still requires this identity verification checks to be completed for relevant transactions from 1 July 2026 onwards. In many cases, we may simply need to confirm or update the information we already hold.
